Please read these Terms of Service (“Terms”) carefully as by accessing and using this website and/or the Service you are deemed to have read, understood and agreed to the following disclaimer and the Terms of Service. Stated exclusions and limitations apply only to the extent permitted by law. Your statutory consumer rights are unaffected.

The following terminology applies to these Terms of Service and Privacy Statement and to any and all agreements. An individual or business accessing the PatrolPress website, using the Service or requesting work from PatrolPress will be referred to as ‘the Client’, ‘You’ or ‘Your’. ‘The Company’, ‘Ourselves’, ‘We’ ‘Our’ or ‘Us’ refers to PatrolPress. These Terms of Service form part of the contract between PatrolPress and the Client.

Use of Services

You may use our services, provided that you are of legal age to form a binding contract and are not barred from receiving such services under the laws of the United States or other jurisdictions. In order to access our service, you are required to provide current and factual identification, contact, and other information as part of the sign-up process. You are responsible for the confidentiality of your information and for all activities that occur under your account.

Our Service

PatrolPress is an online service that offers small work requests, monthly maintenance, and other support via email for single-site installations of WordPress. Services include, but are not limited to, any service and/or content PatrolPress makes available to or performs for you, as well as the offering of any materials displayed, transmitted or performed on the Site or through the Services.

Due to the variable nature of multisite installations, WordPress Multisite support is not included as part of our service.

Your access to and use of the Site may be interrupted from time to time as a result of equipment malfunction, updating, maintenance or repair of the Site or any other reason within or outside the control of PatrolPress. PatrolPress reserves the right to suspend or discontinue the availability of the Site and/or any Service and/or remove any Content at any time at its sole discretion and without prior notice.

Payment

You agree that you will pay for the Service and that PatrolPress may charge your payment method for the service purchased and for any additional amounts (including late fees, as applicable) that may be accrued by or in connection with your account.

The price payable for the Service is the net price (after deduction of any discounts) and is exclusive of all taxes, levies, or duties imposed by taxing authorities, which if applicable shall be your responsibility to pay in addition to the price.

Prices for the Service may change at any time by giving you thirty (30) days or more prior written notice. New prices will apply to the next payment period. The Service does not provide price protection or refunds in the event of a price reduction or promotional offering.

Scheduling Work

All work requests should be submitted via email to support@patrolpress.com. We will acknowledge all work within two hours during business hours of Monday-Friday 9am-6pm. PatrolPress will not schedule work until all essential information is received. The Client will ensure that all information necessary to complete the task is provided.

Work requests are subject to a maximum of 30 minutes of support time and should fall within the following categories:

  • WordPress consultation (advice and troubleshooting)
  • Content population
  • Theme changes and troubleshooting
  • Plugin installation and implementation
  • Security updates
  • Graphics and image manipulations
  • Styling elements with CSS
  • Creation of basic graphics (e.g. buttons, banners, etc.)
  • HTML, CSS and JavaScript optimization and troubleshooting

All work request are subject to approval from PatrolPress. Examples of requests not meeting approval for small work request time:

  • Website redesign
  • Custom plugin development
  • Custom theme development
  • Search marketing/SEO services
  • Any fix deemed by PatrolPress to exceed 30 minutes of support time

If you are unsure about the whether or not a work request meets the criteria, submit a work request to our support team and we will either accept the request or deny the request based on managerial approval.

Reasonable Use

Our services are provided subject to reasonable use. You accept that the term ‘reasonable use’ is determined by PatrolPress at its sole and exclusive discretion.

Use of the term ‘unlimited’ in describing our Service is subject to reasonable use. We reserve the right to contact you if we feel that you are abusing the use of our Service in an excessive manner. PatrolPress solely defines the term ‘excessive’. We reserve the discretion to suspend service to you if we deem necessary in relation to the above.

Termination and Cancellation

If you are unhappy with your experience from PatrolPress or the Service provided, you may cancel your account at any time and you will not be automatically renewed or billed for your account as of the date of cancellation. If you wish to cancel your PatrolPress account, you must contact us in writing with your cancellation request. You can contact us through the contact page or by submitting an email to support@patrolpress.com.

PatrolPress may terminate or suspend the Service and/or your PatrolPress account immediately, without prior notice or liability, for any reason whatsoever, or for no reason, including without limitation if you breach the Terms. Upon termination of your account, your right to use the Service will immediately cease. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Limitation of Liability

PatrolPress shall not be liable under any circumstances to you under any legal or equitable theory, including but not limited to contract, tort, strict liability, negligence, common law or with respect to the site, the service or any content (i) for any lost profits, loss of use, or actual, special, indirect, incidental, punitive, or consequential damages of any kind whatsoever.

PATROLPRESS MAKE NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO THE SERVICES TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW. YOU ACCEPT THAT YOUR SOLE REMEDY SHALL BE YOUR ABILITY TO TERMINATE THE SERVICE

Indemnification

To the extent authorized by law, you agree to indemnify and hold harmless PatrolPress, its employees, officers, directors, affiliates, and agents from and against any and all claims, losses, expenses, damages, and costs, including reasonable attorneys fees, resulting directly or indirectly from or arising out of (a) your violation of the Terms, (b) your use of the Service, and/or third-party materials or websites.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or man-made eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavours to comply with the terms and conditions of any Agreement contained herein.

All information displayed on this website, including, articles, text, and the full content of the website itself are the sole and exclusive intellectual property of PatrolPress. You may not copy, modify, or reproduce the material on this site in any manner whatsoever.

Privacy Policy

PatrolPress is committed to responsibly handling the information and data we collect through our Service in compliance with our Privacy Policy, which is incorporated by reference into these Terms. Please review the Privacy Policy so you are aware of how we collect and use your personal information.

Right to Amend

From time to time, and at our sole discretion, PatrolPress reserves the right to make any changes to these Terms and Conditions of Use without prior notification. Visiting and using the site or Service following any change in the terms offered, the Terms and Conditions of Use, or Privacy Policy constitutes both notice of the change and your acceptance of any changes.
